The Department of Home Affairs has made many changes to the eligibility criteria for the 485 Visa Australia holders affected by travel restrictions imposed due to the pandemic.

The new set of requirements contains the following.

  • If you have undertaken online study outside Australia on your Student Visa 500, it will allow you to meet the Australian study requirements.
  • An offshore application for Visa 485 is now possible, provided you satisfy the other visa eligibility criteria.

It will be helpful, especially if your student visa has expired and you find it difficult to return to Australia.

Keep in mind that you must apply within 6 months of completing your course.

Flexible Timeframes for Health Examinations and English Language Proficiency Tests

Many services have faced disruptions because of the COVID-19 pandemic. If you have not been able to undergo health examinations, the Department of Home Affairs will allow you extended deadlines to undertake the mandatory health checks.

You may also have been unable to appear for your English language test due to the COVID-19. In that case, the Department of Home Affairs will allow some extra time to submit your English language test results.

Future Flexibility on Temporary Graduate Visa and Post-Study Work Visa 485

As a prospective Temporary Graduate Visa Subclass 485 applicant, you will be able to enjoy more flexible benefits.

  • Post-Study Work Stream visa validity period has been permanently increased from 2 to 3 years for students enrolled in a Masters by Coursework.
  • As of now, VET (Vocational Education and Training) graduates could stay 18 months on their Graduate Work Stream Visas. But now they can stay for a maximum of 24 months. However, keep in mind that this is a temporary measure.
  • Another temporary measure has been introduced for Graduate Work Stream applicants.

Graduate Visa 485 holders who are more likely to be benefitted are those holding the Graduate Work Stream. The extended period of stay will give them additional time to complete their JRP (Job Ready Program).

Holders of 485 Graduate Visa can get their visa extended or enlivened if they have been affected by the COVID-19.

Eligibility criteria for the Graduate Visa automatic extension are as follows.

  • You must have held your 485 Visa on 15 December 2021.
  • You must have been in Australia when the Department granted you the visa.
  • Your current visa must expire before 30 September 2022.
  • You have not been in Australia for a period between 1 February 2020 and 14 December 2021.
  • You have not been issued another substantive Australian visa since 15 December 2021.

For visa enlivening, make sure that you meet the following criteria.

  • Your temporary graduate visa should have expired between 1 February 2020 and 14 December 2021.
  • You should have been present in Australia at the time of the visa grant.
  • You have not been in Australia for a period between 1 February 2020 and 14 December 2021.
  • The Department has not issued any other substantive visa.

The automatic visa extension does not involve any fee.

What Documents Should You Submit to Make a Successful Application?

Identity Documents

  • Ensure that your passport is up-to-date, and submit copies of its pages containing your personal details and photographs.
  • A national identity card is required.
  • Photographs
  • A name change proof, if applicable

Relationship Documents

Depending on your relationship status, submit your marriage certificate, divorce certificate, or statutory declaration certificate.

Academic Documents

In support of your Australian study, you have to submit a course completion letter issued by your university or institute. This letter should mention:

  • The CRICOS code of your course,
  • The course commencement and completion dates,
  • Whether you have met all the course requirements,
  • The language of instruction, and
  • The location of the institute campus

In addition, you will also need to submit your academic transcripts.

English Language Documents

If you are from an English-speaking country, there will be no need to provide separate English language documents.

But if you are not, make sure that you submit the score of an internationally accepted English language test like IELTS, TOEFL, or PTE.

When you include your spouse or partner in your 485 Visa application, submit their:

  • Birth certificates or adoption papers
  • Filled-in Parental Consent Form

While including dependent children aged 18 and 23, provide evidence that they are financially dependent on you or your spouse.

Health and Character Documents

  • Health examination reports
  • AFP clearance certificate
  • Clearance certificate issued by police departments of every country you have lived in for at least 1 year in the last 10 years since you have turned 16
